The Ukrainian State Centre of Radio Frequencies -Centre "Ukrchastotnaglyad" is a specially authorized radio frequency body, acting as a State Telecommunications Inspection of Ukraine (STI) and belonging to the governing scope of Communications Administration of Ukraine, the powers of which are entrusted to the State Committee of Communications and Informatization of Ukraine.
The Centre "Ukrchastotnaglyad"acts in accordance with the normative and legal documents listed in Section "Legal foundation of the Centre activities".
Powers of the Ukrainian State Centre of Radio Frequencies - Centre "Ukrchastotnaglyad"are stipulated in the Article 7 of the Law of Ukraine "On Radio Frequency Resource of Ukraine":
- assigning radio frequencies and call-signs;
- issuing permissions for designing, modernization, manufacturing, purchase, implementation ,sale ,usage of radio electronic facilities (REFs)and radio radiating devices on the territory of Ukraine, as well import of the above-mentioned ones for civil and military users;
- radio monitoring, registration and state supervision for the use of radio frequency resource of Ukraine by civil and military users;
- participating (in accordance with the established procedure) in the work of the International Telecommunication Union (ITU)and other international organizations dealing with the issues of radio frequency resource usage, including international legal support and coordination of frequency assignments;
- participating in the preparing draft laws and other normative and legal bills, as well conducting the scientific and experimental researches on radio frequency resource in Ukraine;
- executing other powers in compliance with the Laws of Ukraine.
According to the given powers and acting Statute the Centre "Ukrchastotnaglyad" performs the functions as follows:
Monitoring and supervision of such activities as:
- manufacturing, implementation (selling), importing, usage of REFs for civil purpose;
- ensuring the level of admissible interference for radio and TV reception;
- fulfilling the licensing provisions by the licensees in the field of telecommunications;
- utilization of the only standardized equipment the communication network as for public and departmental usage.
Permissive functions –according to the results of the expertise on compliance with the EMC parameters (National standards of Ukraine):
- assigning frequencies for REFs of civil use;
- drawing up permissions for designing, modernization, implementation (sale), purchase, operation and import of REFs to Ukraine;
- agreeing the requirements specification for designing and technical specifications for serial manufacturing of REFs;
- drawing up permission for utilization of areas for REFs location.
Prohibitive functions:
- establishing the restrictions for REFs use while conducting the emergency works and measures;
- expropriating (according to the established order)the REFs operating on non-licensed basis or with divergence of frequency assignment parameters;
- making proposals on discontinuing the operators` non-licensed activities in the field of communications or their operation in case of infringements in the licensed provisions;
- discontinuing or suspending the validity of permission for implementation (purchase), constructing, operating and importing the REFs;
- instructing the legal or natural persons to eliminate the infringements in the procedure for using REFs.
Compulsory functions:
- Applying the penalty sanctions, making proposals related to bringing the legal or natural persons to administrative proceeding for violating the legislative provisions while executing the activities in the field of communications or using REFs.
Regulatory functions:
- Frequency use planning for various REFs ;
- Drawing up the normative, technical and informational documents;
- Consideration of applications and complaints from frequency users and taking the corresponding decisions.
International legal support functions:
- Protecting the interests of Ukraine relative to radio frequency resource usage in international organizations;
- Notification of the Ukrainian REFs frequency assignments in the ITU;
- Coordination of the REFs usage for mobile communication, TV, broadcasting, fixed services, and fixed and broadcasting satellite services with the neighboring countries as well.
Technological functions:
- Radio frequency monitoring;
- Testing the manufactured products with the object to determine harmful interference.
The objects of the functions implementation, performed by the Centre "Ukrchastotnaglyad" are enterprises, institutions, organizations, other legal persons independently of the form of property and departmental subordination, natural persons that render the postal and electrical communication services and also use REFs or high-frequency devices (excluding the objects of governmental communications, communication networks of state regulation in the field of defense, extraordinary situations, security and protection of law and order).
Implementation of international legal activities on spectrum management is entrusted to the Communications Administration, which enlists the authorized bodies, including the Centre "Ukrchastotnaglyad".
International cooperation of the Centre "Ukrchastotnaglyad" covers the following directions:
- International legal support to the REFs of Ukraine that involves the international coordination of Ukrainian frequency assignments of REFs and other countries as well notification, coordination and registration of frequency assignments of Ukraine in the ITU.
- Participation in the work of the ITU Study Groups, World and Regional Radio Communication Conferences, Radio Communication Assemblies and Plenipotentiary Conferences.
- Involvement in the activity of the CEPT ECC Working Groups
- Participation in the work of the Regional Commonwealth in the field of Communications (RRC).
- Holding bilateral and multilateral meetings with representatives from the Communication Administrations of neighboring states pertinent to coordination of radio frequency usage near the border areas.
- Organizing and holding the international workshops on frequency resource management.
